Do you want a loan modification for your FHA loan? You are in the same boat as millions of Americans who are unable to receive modifications for their FHA loan because the regulations surrounding these in the case of FHA loans are strict and, in most cases, unreasonable.

At this time, in order to qualify for a loan modification on your FHA loan, your current property can not be below 90 percent of the initial buying price. Most homeowners are lucky if their home value is still at 85 percent right now. On top of that, you, the borrower, must have been late on your mortgage payments for three months. Yes, people are having trouble paying their mortgages but requiring that a homeowner be late for three months is ridiculous. That is three months of harassing phone calls and more headache than needed.

Most lenders who are not under the FHA do not require a full 90 percent of original property value — some lenders do not even inquire about the home’s current value. Those who do have the home appraised or inquire about the home’s current value usually do not require such a high and almost impossible percentage. In fact, there are so many homeowners do not meet that one requirement that the entire loan modification portion Housing and Economic Recovery Act has been a complete bust.

The Obama Administration is currently attempting to meld the modification FHA standards to be more akin to the Home Affordable Loan Modification Program, but for now families and homeowners who have mortgages through the FHA are completely vulnerable to foreclosures.

Having a lender approve of your loan modification is difficult enough, with many lenders pensive to work with homeowners and many more unable to cope with the massive amount of requests for these. Lenders are under constant pressure with the housing crisis and millions of homeowners with FHA loans who are unable to afford their mortgage are applying for no reason whatsoever, because they are simply not allowed to have it because their current home value is below 90 percent. It is all turning out to be a big vicious cycle.

If you happen to be a homeowner seeking loan modification via FHA loans, you are out of luck for now. While the cogs of politics are grinding away trying to find a solution, you are one of the millions who are up the creek without a paddle. There will be some sort of change in the near future to assist those who have FHA loans actually receive assistance, but it is coming slowly. For the time being, thousands in financial hardship are losing their homes to foreclosure because there is no way to fight for them in this sort of financial climate.

How to Start Home Based Business and Get Government Help

 This help will come in two different forms, either grants or loans. Grants do not have to be paid back. Loans do, but government loans for small businesses are usually easier to get and have better terms than private ones. If you search the net you will run into many people trying to get you to pay money to process loans and grants. Do not waste your money! Read this article to get started.

Get a Grant

Money is allocated by the local, state, and federal government to encourage business development. Grants are usually dedicated in a category of industry (such as agriculture, green, or health care), or a category of the entrepreneur, (such as women, minorities, or dislocated employee), or geographical area (such an area of a community or state that has been determined as economically depressed).

There are hundreds of websites that help folks sort through the maze of government grants. Because there are so many options and rules, the process can be a little intimidating, but anyone can do it with a little determination. There is no reason to get roped into spending money to get a grant. Many sites will try to get you to pay for information, or sell you on the idea of paying someone to help you get the grant. This is completely unnecessary.

Run “government grants for startup” through a search engine and you will find hundreds of websites that can help you walk through the maze of the current grant situation. Start with http://www.grants.gov. This site will provide all the information you need to apply for a grant from the feds. Look up your state’s “attorney general” website. Then call your city hall to be directed to any local help. Many cities have programs to promote local startups, which are usually through the chamber of commerce. The goal of the communities is to increase employment and tax revenue for the city.

Get a Loan

One common sense guideline is to always exhaust every effort to get grants before making the decision to take out loans. Of course, it’s better to get money you don’t have to pay back than to be roped into making payments on a loan for years to come. I have found the worst government loans are better the best private ones.

The motivation for the government providing low-interest loans to startups is the same as the grants. They want to grow the economy, provide more jobs, and grow the tax revenue base.

The process of getting a startup loan is almost identical to that of a grant. The same entities that provide grants supply loans (or can least direct you to those that can.) Things certainly vary from state to state. The main federal government website to initiate the loan process is http://www.sba.gov. Then, like the grant process, I would followup with your state’s attorney general’s office and the local chamber of commerce.

                                             The Economic Impact of FHA Loans

 

 

 

Owning a home is a dream cherished by many people. Unfortunately, not everyone is able to afford a home. So when terms of loans are relaxed, many people seize the opportunity to pursue their dream of becoming a homeowner. This is what transpired when conventional Adjustable Rate Mortgage loans (ARMS) hit the market. Banks financed almost every applicant who applied for home loans and offered the option of a small down payment and a low introductory adjustable rate. People jumped at this opportunity and purchased their dream home, even though for many it was beyond their means.

With the increase of sales volume, real estate prices began to rise. Introductory rates started to adjust and interest rates on mortgages began to climb. Homeowners who had opted for these conventional loans experienced a drastic increase in their mortgage payment almost overnight. Many could no longer afford their home. As real estate prices continued to fall, homeowners attempted to negotiate with their banks. Many were unsuccessful. Most were forced to short sell, or simply walk away from their homes. The increase in the number of defaulters had a cascading effect on the economy leading to the highest recorded number of homes in foreclosure in recent history.

FHA Loans to the Rescue

Federal Housing Administration loans, commonly referred to as FHA loans, have the backing of the Housing and Urban Development which is actually a cabinet department of the executive branch. These loans have been in existence since 1934. When the real estate bubble burst, homeowners were looking for any solution to save their homes. This brought visibility to FHA loans which have relaxed loan requirements, modest down payment requirements, and competitive interest rates.

As property values dropped and interest rates adjusted, FHA loans gained popularity. Because FHA loans are less restrictive, more people qualified for these loans. Many homeowners switched to FHA loans and locked in their rates.

Until about 3 years ago, only 3% of the population had FHA loans. Today close to 50% of American homeowners have refinanced their homes and were able to stabilize their financial situation with the help of FHA loans.

Impact on the Economy

FHA loans have saved many homeowners from foreclosure during these tough economic times. The absence of these loans could have had a catastrophic impact on an already fragile economy.

Today, the real estate market is slowly improving, however many Americans are still feeling its devastating effects. With the help of FHA loans, we look to a future real estate market that will not only allow Americans to dream of one day owning a home, but one that will allow Americans to own a home they can truly afford.

One of the benefits of serving in the United States Military is the right to use the VA loan benefit. A VA refinance mortgage can help homeowners refinance their current mortgage loan in order to lower their current interest rate, eliminate mortgage insurance, and/or consolidate debt.

Types of VA Refinance Mortgages

There are three main types of VA refinance mortgages that can be used in different situations. If a homeowner who is a current service member or veteran of the Armed Forces wishes to not only refinance his current mortgage, but also consolidate debt, the cash-out VA refinance mortgage would be the best product, regardless of his or her current loan type. If a homeowner currently does not have a VA loan, but wants to take advantage of the benefits offered by this program, he should use the VA rate-term refinance mortgage. If a homeowner currently has a VA loan and wishes to lower his interest rate, the type of refinance that may best suit him is the Interest Rate Reduction Refinance Loan.

Cash-Out VA Refinance Mortgage

This type of VA refinance loan is available to anyone, regardless of their current loan type, provided that they qualify on the basis of military service, credit, and income eligibility. Currently, most lenders allow borrowers using a VA loan to cash out up to 90% of their home’s value. This money can be used to consolidate debt or simply to obtain additional funds for whatever reason the homeowner chooses. Many homeowners use this type of loan to eliminate costly revolving debt and to decrease their monthly payment obligations. Unlike credit card interest, the interest on a homeowner’s mortgage can be low, fixed, and tax deductible.

Rate-Term VA Refinance Mortgage

A rate-term VA refinance mortgage allows homeowners to refinance up to 100% of their home’s value and take advantage of all the benefits that this program has to offer. With a VA loan, the homeowner will never be required to pay monthly mortgage insurance and will have access to low, fixed rates. This type of VA refinance mortgage can significantly lower monthly payments without high out-of-pocket expenses.

Interest Rate Reduction Refinance Loan (IRRRL)

This type of VA refinance mortgage is a streamlined mortgage and is only available to homeowners who currently have a VA home loan. This refinance can be used to obtain a lower interest rate, change the terms of the loan, change the current borrowers, and change to a fixed interest rate from an adjustable rate. When a borrower uses an IRRRL, there are no out-of-pocket costs and no appraisal is required. As a convenience to those who have already used their VA home loan benefit, there are also reduced documentation requirements for income information, asset information, and employment, as well as quick application processing.

There are many different types of VA refinance mortgages that are set up to benefit veterans in different situations. VA home loans can provide great benefits to those who have served their country.

The FHA home loan has been the poster child for first time home buyers for several years, and with good reason.  The low down payment, the generous loan amounts, and the low private mortgage insurance rates have been a real boost to helping many people acquire their first home.  There are some other features of Wisconsin FHA loans that some people may not fully understand.

As far as mortgage insurance goes, the general population feels it is just a protection for the lender.  For the most part, this is correct.  Whether we are discussing private mortgage insurance for a conventional loan or the FHA mortgage insurance, the monies are placed into a specific fund.  The fund is used to pay lenders if the borrowers fail to make the payments on the loan.

But FHA has a special clause.  For borrowers that suffer from a serious illness, become temporarily unemployed or has any event that momentarily prevents them from paying their mortgage obligation, FHA has a small relief.  FHA is not in the foreclosure business.  In order to help people in these types of situations FHA will allow borrowers to miss up to three consecutive payments while they get their income back to normal.  Those three payments are placed as a second mortgage on the loan.  The second mortgage will be paid when the home is sold or refinanced.  In order to get this approved a borrower will need to talk to one of the Housing Counselors from a HUD office.

Another benefit of the FHA loan is the modified appraisal requirements.  Up until a few years ago the FHA restrictions on appraisals were a burden to some sellers, especially in the case of older homes.  Many times a buyer would put an offer on a home only to find out that the seller had to make numerous repairs in order to get the home ready to pass the FHA appraisal process.  This has been radically revamped.  The basic intent of the newer requirements is to ensure that a home is safe and healthy for the new owners.

Taking advantage of the low Wisconsin FHA rates and the wonderful features that it offers is still a great move for many first time home buyers.

Over the course of the last year, federal laws regarding loan modifications have changed radically.  Between the end of George W. Bush’s presidency and Barak Obama’s new administration, federal laws  have opened new opportunities for homeowners to avert foreclosure and have access to loan modifications.

Basically, there are four core laws which create the guidelines for all mortgages.  These laws attempt to make the guidelines uniform, based upon equality and that they be administered fairly.  All lenders are required to operate under certain rules, regulations and procedures when taking loan applications.  The rules are: the Real Estate Settlement Procedures Act (RESPA), the Truth in Lending Act (TILA), Equal Credit Opportunity ACT (ECOA) and the Fair Credit Reporting Act (FCRA).  Some of these laws are quite old and were passed in a very different era, but Congress hopes that these rules provide the kinds of guidance that will help people borrow money to get a home without being taken advantage of.

RESPA requires lenders to give a good faith estimate of all closing costs that you are likely to pay.  The hope is to keep the borrower from being forced to pay hidden fees at closing.

TILA requires that annual percentage rate (APR), term of the loan and total costs be disclosed to a borrower prior to extending credit to the borrower.  This information must be obvious on documents presented to the consumer before signing, as well as on periodic billing statements (although that is less often).    Obviously, subprime mortgages, and other “creative” forms of mortgages, may have violated this law.

ECOA prohibits any discrimination in lending based on race, creed, religion, national origin, sex, marital status or age.  Discrimination does not just mean refusing to give a mortgage, it could also mean taking advantage of people and giving them unfavorable mortgage terms just because of their minority status.  

FCRA promotes accuracy, fairness and privacy of information in the files of consumer reporting agencies.  When you apply for a mortgage, the lender always pulls a credit report and FCRA gives you access to the report they pull.  If you have ever been rejected for a credit card, you will doubtless have received a letter explaining the decision and informing you of your right to view your credit report; this is due to FCRA.

California loan modification attorneys are familiar with the state and federal laws governing loan modifications, as well as how those laws can be used to benefit your situation.  If you are facing foreclosure, there is a chance that your mortgage company might have violated one of these statutes.  This could be used as leverage either during a loan modification or even during litigation.  The federal government is still investigation how often mortgage companies such as Countrywide violated these laws in selling people subprime mortgages.  Having a mortgage with a highly fluctuating interest rate certainly seems to violate some of the federal laws mentioned above, as does the tactic of lying about the borrower’s income (which some real estate agents did quite often).  A loan modification attorney can be a big help in figuring out just how the laws governing mortgages can benefit you.
